Welcome to Pixto, an AI Visual Content Studio designed to help you generate images, create character illustrations, remove backgrounds, and craft videos with advanced AI technology. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Use of the Service

Pixto provides users with a comprehensive AI-powered platform for visual content creation, including image generation, character illustration, background removal, video creation, and complete AI visual production pipelines. You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations.

User Accounts and Registration

1. Account Creation: To access certain features of the service, you need to create an account. You must provide accurate and complete information during the registration process.

2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Content and Intellectual Property Rights

Your Content

• Ownership: You retain ownership of all content you upload to Pixto (text prompts, images, videos, etc.).
• License to Process: By uploading content, you grant Pixto a limited license to process your content through our AI models to provide the requested services.

Generated Content

• Commercial Rights: According to our licensing agreement, you own commercial rights to content generated using our AI tools.
• Attribution: While not required, attribution to Pixto is appreciated when sharing generated content publicly.

Pixto Platform

All technology, AI models, infrastructure, and platform features provided through Pixto are protected under copyright law. The copyright owner of Pixto is pixto.ai.

• You acknowledge that you do not own the underlying AI technology, algorithms, or intellectual property that makes up the Pixto service.
• The core Pixto platform, AI models, and generation capabilities remain the property of pixto.ai.

AI Content Generation Guidelines

When using Pixto's AI tools, you agree to:

• Use the service responsibly and ethically
• Not generate content that violates laws, infringes copyrights, or harms others
• Not attempt to generate inappropriate, offensive, sexually explicit, sexually suggestive, NSFW, pornographic, nude, fetish, exploitative, or illegal content
• Respect the terms of service of underlying AI model providers (Flux, Kontext, Veo3, etc.)
• Not use generated content to impersonate real individuals without consent
• Comply with our Acceptable Use Policy

Pixto screens user prompts for AI image and video generation through content safety checks, including Creem's Moderation API where required for payment compliance. Prompts that are rejected, flagged, or cannot be screened may be blocked before generation.

Acceptable Use and Content Safety

You may not use Pixto to request, create, upload, distribute, sell, or promote:

• NSFW, sexually explicit, pornographic, nude, fetish, sexually suggestive, or borderline sexual content
• Sexualized depictions of minors or any content involving child sexual exploitation or abuse
• Non-consensual intimate imagery, sexual deepfakes, face-swap abuse, or face-manipulation intended to deceive, harass, or exploit
• Harassment, threats, hate, abuse, self-harm instructions, violence, illegal activity, or other harmful content
• Content that infringes intellectual property rights, privacy rights, publicity rights, or the rights of AI model providers

We may block prompts, refuse generation, remove content, suspend accounts, or terminate access when we believe content or conduct violates these Terms, our Acceptable Use Policy, payment processor requirements, or applicable law.

Prohibited Activities

You agree not to engage in any of the following prohibited activities while using Pixto:

• Generating or distributing illegal, harmful, or offensive content
• Generating or distributing NSFW, sexually explicit, pornographic, sexually suggestive, or exploitative content
• Attempting to reverse engineer or extract our AI models or proprietary algorithms
• Using the service for spam, harassment, or malicious activities
• Interfering with or disrupting the security or performance of the service
• Attempting to bypass usage limits, payment requirements, or security features
• Violating the intellectual property rights of others through content generation
• Reselling or redistributing Pixto's AI capabilities without authorization

AI Model Usage and Third-Party Services

Pixto utilizes various third-party AI models and services (including but not limited to Flux, Kontext, Veo3, Replicate, FAL.ai) to provide our services. By using Pixto, you also agree to comply with the terms of service of these underlying providers.

Privacy and Data Collection

Pixto collects the following types of data:

• Account Information: Information you provide when creating an account
• Content Data: Images, videos, prompts, and other content you upload or generate
• Usage Details: Data related to your activity and AI tool interactions on our service
• Device Information: Information about the device you use to access our service
• Analytics Data: Data that helps us enhance your experience and improve our AI models
• Payment and Billing Information: Data necessary to process payments

AI Model Training and Improvement

• All purchases are final and non-refundable unless otherwise required by law

• You agree to pay all charges associated with your selected plan or usage
• Payment terms are based on your selected payment method and subscription plan
• Credits or usage allowances do not expire unless specified in your plan
• Fair usage policies may apply to prevent abuse of unlimited plans

Service Availability and Performance

Termination

• The reliability or availability of the service
• The compatibility of generated content with your intended use
• The performance or results of AI models

We disclaim all warranties to the fullest extent permitted by law.

Limitation of Liability

To the fullest extent permitted by law, pixto.ai shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• The use of or inability to use the service
• AI-generated content that does not meet your expectations
• Service interruptions or technical issues
• Actions taken based on AI-generated content

Indemnification

You agree to indemnify and hold harmless pixto.ai, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the service or violation of these Terms
• Content you generate or share using our AI tools
• Any violation of third-party rights through your use of the service

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which pixto.ai operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the service will be resolved through binding arbitration in accordance with applicable laws.

Changes to These Terms

We reserve the right to update or modify these Terms at any time to reflect changes in our services, legal requirements, or business practices. Changes will be effective immediately upon posting on our website. Your continued use of the service after any changes signifies your acceptance of the new terms.
